Terms of Service
These Terms of Service are the agreement between you and Jivanlax Foods ('Jivanlax Foods,' 'we,' 'us') whenever you place an order, request a custom or wholesale order, or otherwise buy from us. By completing a purchase, you agree to these Terms, our Refund Policy, our Shipping Policy, our Website Terms & Conditions, and our Privacy Policy, which together make up the full agreement.
1. Who can order
You must be at least 18 years old, or have a parent or guardian's permission, to place an order. You agree that the information you give us, including your name, address, and payment details, is true and complete.
2. About our products
Handmade in small batches.
Each bar is made by hand, so weight, shape, and color may vary slightly from photos and from batch to batch. Net weight on each label is accurate.
Made in a Home Kitchen in California.
Our products are prepared in a home kitchen in Irvine, California.
Allergens.
Our products contain or may contain tree nuts, peanuts, seeds of all kinds (including sesame), coconut, dates, milk, and chocolate. Everything is made in the same kitchen, so cross-contact between ingredients is possible. Always read each product's ingredient list before ordering or eating. We cannot guarantee any product is free from any allergen.
Freshness.
Our bars contain no artificial preservatives. Follow the storage directions and best-by date on each package.
3. Orders and acceptance
Placing an order is an offer to buy. We accept your order when we send a shipping confirmation, not when you receive the automatic order receipt. We may decline or cancel an order, or limit quantities per customer, household, or payment method, for example if an item is unavailable, we suspect fraud or resale, or the order would exceed what we can safely make. If we cancel after you have paid, we refund you in full.
4. Prices, errors, and payment
Prices are in U.S. dollars and may change at any time before you order. The price shown at checkout is the price you pay.
If a product is listed at the wrong price because of a typo or system error, we will email you before shipping and let you choose to pay the correct price or cancel for a full refund.
Most food products are exempt from California sales tax. If tax applies to any item or fee, it is shown at checkout.
Card payments are processed securely by Stripe and charged when you place your order.
Zelle payments must be sent to the Zelle details shown at checkout, with your order number in the memo. We start making your order once your Zelle payment arrives. Zelle payments can't be reversed by your bank, so please check the amount and recipient before you send.
5. Custom, event, and wholesale orders
Custom-flavor, event, corporate gift, and wholesale orders are confirmed by a written quote or invoice sent by email. That quote will state any deposit, the order deadline, and the cancellation terms, which control if they differ from these Terms. Wholesale buyers must hold any permits required to resell food products.
6. Shipping, cancellations, and refunds
Delivery and risk of loss are covered by our Shipping Policy. We currently deliver only within California. Cancellations, damaged-order claims, and refunds are covered by our Refund Policy. Nothing in these Terms limits any refund right you have under California law.
7. Promotions and discount codes
Discount codes have no cash value, can't be combined unless stated, can't be applied to past orders, and may expire. We may end or change a promotion at any time, but we will honor any code that was valid when you placed your order.
8. Our promise, and its limits
We promise that every product we ship is made with care, labeled accurately, and safe to eat when stored as directed and eaten before its best-by date. If a product does not meet this promise, your remedy is a replacement or refund under our Refund Policy. To the fullest extent California law allows, we make no other promises, express or implied, about our products or the Site.
9. Limitation of liability
To the fullest extent permitted by law, Jivanlax Foods will not be responsible for indirect, incidental, special, or punitive damages, such as lost profits or event costs, arising from your use of the Site or our products. Our total liability for any claim will not exceed the amount you paid for the order involved. These limits do not apply to liability for personal injury caused by our negligence, fraud, willful misconduct, or anything else that California law (including Civil Code section 1668) does not allow a business to limit.
10. Indemnity
You agree to cover Jivanlax Foods for reasonable costs, including attorneys' fees, from third-party claims caused by your breach of these Terms, your misuse of the Site, or your resale or repackaging of our products.
11. Resolving problems
Most concerns can be solved with a quick email. Before starting any legal claim, please email support@jivanlaxfoods.com and give us 30 days to try to resolve it informally.
If we can't resolve it, either of us may bring a claim in the Small Claims Court of the Superior Court of California, County of Orange, if it qualifies. Any other claim must be brought in the state or federal courts located in Orange County, California, and both parties agree to those courts' jurisdiction. Nothing in this section waives any right you have under the California Consumer Legal Remedies Act or any other law that cannot be waived.
12. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
13. Notice to California residents
Under California Civil Code section 1789.3, California users are entitled to this notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs can be reached in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (916) 445-1254 or (800) 952-5210.
14. General terms
Severability.
If any part of these Terms is found unenforceable, the rest stays in effect.
No waiver.
If we don't enforce a term right away, we can still enforce it later.
Assignment.
We may transfer these Terms if our business is sold or reorganized.
Events beyond our control.
We are not responsible for delays caused by weather, carrier failures, natural disasters, power outages, or similar events.
Changes.
We may update these Terms. The version posted when you place an order applies to that order.
